Service Agreement for Eyelash Extensions, Brow Lamination, Lash Lift, Lash Removal, and Retail Products
This Service Agreement ("Agreement") is entered into by the client ("Client") and It's A Lashuation, LLC ("Service Provider"), located at 1201 Airport Freeway #330, Suite #11, Euless, Texas, 76040. By booking, purchasing, or receiving services from It's A Lashuation, LLC, the Client agrees to the terms outlined in this contract.
1. Services Provided
- Eyelash Extensions: Full set, touch-ups, and specialty lashes.
- Brow Lamination & Tinting: Brow shaping, tinting, and lamination.
- Lash Lift: Semi-permanent curling and tinting for lashes.
- Lash Removal: Professional removal of eyelash extensions.
- Retail Products: Lash care products, aftercare items, and other beauty products.
- Eyelash Mapping: Eyelash mapping is a customized design based on your natural lashes to ensure the best extension placement.
2. Client Responsibilities
- Health Disclosure: The Client agrees to disclose any allergies, sensitivities, or existing medical conditions (such as eye conditions, skin conditions, or medications) that may affect the treatment. The Client also acknowledges that certain services may not be suitable for individuals with specific conditions, and the Service Provider reserves the right to refuse service if deemed unsafe.
- Makeup-Free Face: For the best results, the Client agrees to arrive with a clean, makeup-free face, especially around the eyes and brows, to ensure the longevity and effectiveness of the service.
- Cellphone & Behavior Policy: The Client agrees to maintain a peaceful environment by following the salon's policy regarding the use of cellphones, behavior, and not bringing additional guests (children, pets, or companions) to appointments.
3. Appointments and Cancellations
- Appointment Booking: A non-refundable deposit is required to secure an appointment. The deposit will be applied to the service cost, provided the Client follows the cancellation policy.
- Cancellation Policy: Cancellations must be made at least 48 hours prior to the scheduled appointment. Failure to do so will result in the forfeit of the deposit or 100% of the service cost for no-shows.
- Late Arrivals: Clients who arrive more than 10 minutes late may be required to reschedule their appointment, and a cancellation fee will apply.
4. Eyelash Mapping and Customization
- Eyelash Mapping: Lash extensions are customized based on your natural lashes, eye shape, and desired style. The Client agrees to the lash mapping process as determined by the Service Provider. Changes to the design once the procedure has started may incur additional fees.
- Consultation: Prior to any eyelash extensions, the Client will undergo a consultation where a Service Provider will assess the Client’s lash health and discuss the preferred look. Client consent is required to proceed.
5. Lash Removal
- Lash Removal: The Client acknowledges that eyelash extensions may need to be removed at some point to maintain eye health or if they are no longer desired. Lash removal services are offered at It's A Lashuation, LLC and are highly recommended for safe removal of eyelash extensions. If the Client wishes to remove extensions, the Service Provider will ensure the procedure is performed safely and carefully.
6. Aftercare and Maintenance
- The Client agrees to follow all aftercare instructions provided by It's A Lashuation, LLC for the best results and longevity of eyelash extensions, lash lifts, brow lamination, and tinting. Failure to follow aftercare instructions may lead to damage, and the Service Provider will not be held responsible for poor results.
- Eyelash Extensions: The Client understands that touch-up appointments are necessary every 2-3 weeks to maintain the fullness of eyelash extensions. Failure to maintain regular appointments may result in additional charges for the service.
7. Retail Products
- Retail Products: All retail products purchased are non-refundable and non-returnable. The Client agrees to use the products according to the provided instructions for the best outcome.
- Damaged Products: In the case of a product defect, the Client must notify the Service Provider within 2 days for a possible exchange. No returns will be accepted after 2 days of purchase.
8. Liability
- Eyelash Extensions & Other Services: The Client acknowledges that while eyelash extensions, lash lifts, brow lamination, and tinting are safe when applied by a trained professional, there are inherent risks such as irritation, allergic reactions, or injury. The Client assumes all responsibility for any adverse effects that may occur during or after the procedure.
- Brow Lamination & Tinting: The Client understands that brow lamination and tinting may cause irritation in some cases. The Service Provider will perform a patch test, if necessary, but the Client accepts the risks involved.
- Lash Removal: The Client acknowledges that lash removal may cause some temporary irritation or discomfort, and although the Service Provider will perform the service safely, they assume all risks related to the removal process.
9. Insurance & Liability
- Insurance Coverage: It's A Lashuation, LLC maintains appropriate liability insurance to cover accidental damage or injury directly caused by our professionals during services. However, this coverage does not extend to pre-existing conditions, personal negligence, or unforeseen reactions to products or procedures. By receiving services, the Client acknowledges and accepts responsibility for their own safety and well-being.
- Liability Waiver: By signing this Agreement, the Client acknowledges and agrees that It's A Lashuation, LLC and its employees or independent contractors are not liable for any injuries, allergic reactions, or other health issues that may arise as a result of eyelash extensions, brow lamination, lash lifts, lash removal, or any other services. This includes but is not limited to eye infections, irritations, or allergic reactions caused by products used during the service. The Client agrees to indemnify and hold harmless It's A Lashuation, LLC from any claims or damages arising out of such events.
- Assumption of Risk: The Client fully understands and assumes all risks associated with receiving beauty services such as eyelash extensions, lash lifts, brow lamination, lash removal, and tinting, and acknowledges that they have voluntarily consented to the procedures.
10. Confidentiality and Privacy
- Client Information: The Client’s personal and medical information will be kept confidential and used only for the purposes of providing the services requested. The Client agrees that any photos or videos taken before, during, or after services may be used for promotional purposes, provided the Client consents.
11. Refund and Return Policy
- Services: All services, including eyelash extensions, lash lifts, brow lamination, lash removal, and tinting, are non-refundable. If the Client is not satisfied with the result, they must notify the Service Provider within 48 hours. The Service Provider will offer to correct any issues at no additional charge if within the 48-hour window.
- Retail Products: All retail products are final sale and non-refundable unless defective. If a product is found to be defective, the Client must contact It's A Lashuation, LLC within 2 days for an exchange or store credit.
12. Health and Safety Protocols
- The Client agrees to follow all health and safety guidelines set forth by It's A Lashuation, LLC, which may include wearing a mask, following sanitation rules, or adhering to any other relevant safety measures. The Service Provider reserves the right to refuse service if health and safety protocols are not followed.
13. Additional Services
- Any additional services requested by the Client during the appointment will be subject to additional charges, which will be communicated and agreed upon before the service begins.
14. Photography and Social Media
- The Client agrees that It's A Lashuation, LLC may take before and after photos of their service for promotional purposes. These images may be shared on social media platforms, website galleries, or marketing materials.
15. Service Provider’s Right to Refuse Service
- The Service Provider reserves the right to refuse service to any Client for reasons including but not limited to non-disclosure of health information, unprofessional behavior, intoxication, or inability to follow instructions or policies. The Client will be notified if the service is refused, and any deposits will beforfeited.
16. Governing Law
- This Agreement will be governed by the laws of the state of Texas, where It's A Lashuation, LLC is legally registered, and any disputes will be resolved in the appropriate jurisdiction.
17. Modification of Terms
- It's A Lashuation, LLC reserves the right to modify or update this Agreement at any time. Any changes will be communicated to the Client, and the updated terms will apply to all future appointments or purchases.
Release of Liability & Waiver
By booking, purchasing, or receiving services from It's A Lashuation, LLC, the Client acknowledges and agrees to the following:
1. Assumption of Risk: The Client understands that eyelash extensions, brow lamination, tinting, lash lifts, lash removals, and other related beauty services involve inherent risks, including but not limited to allergic reactions, irritation, discomfort, infection, or damage to natural lashes or skin. The Client voluntarily assumes all risks associated with these services.
2. Medical Conditions & Allergies: The Client confirms they do not have any known medical conditions, allergies, or sensitivities that may interfere with the services provided. If the Client has any concerns, they have consulted with a medical professional prior to their appointment. The Client agrees to disclose any relevant medical history before the service.
3. No Guarantees: The Client understands that results may vary depending on individual circumstances, lash health, skin type, and aftercare. It's A Lashuation, LLC does not guarantee specific results and is not responsible for variations in outcome.
4. Aftercare & Maintenance: The Client acknowledges that proper aftercare is essential for maintaining the results of the service. The Client agrees to follow the aftercare instructions provided and understands that failure to do so may affect the longevity and quality of the results.
5. Liability Waiver: The Client releases It's A Lashuation, LLC, its employees, contractors, and affiliates from any liability, claims, or damages arising from the service provided. This includes, but is not limited to, adverse reactions, accidental injury, or dissatisfaction with the service.
6. Photographic and/or Video Consent: The client grants It's A Lashuation, LLC permission to capture photos or videos of their service results for marketing, training, and portfolio purposes, without requiring additional consent beyond this agreement.
7. Legal Agreement: By proceeding with any service, the Client acknowledges that they have read, understood, and voluntarily agree to this Release of Liability & Waiver.
